2. ELIGIBILITY

Open to Canadian residents who have reached the age of majority in their province or territory of residence as of the date of entry and have internet access. Employees, agents and representatives of the Giveaway Organizer or of its subsidiaries, their advertising and promotional agencies or suppliers of prizes, products, services and material related to this giveaway, as well as members of their immediate family (brothers, sisters, children, father, mother), their legal or common-law spouse and any individuals with whom such employees, agents and representatives are domiciled, are not eligible.

3. HOW TO ENTER

NO PURCHASE NECESSARY

Internet access and valid Instagram account are required. During the Contest Period, test the new NIVEA Anti-Wrinkle Specialist Targeted Filler and leave a review on both the official NIVEA Canada website at https://www.nivea.ca/en-ca/products/q10-anti-wrinkle-specialist-targeted-wrinkle-filler-565940179930055.html#layer=write-review (“the Q10 ANTI-WRINKLE SPECIALIST TARGETED WRINKLE FILLER page”), and the Shopper Drug Mart website at https://ui.powerreviews.com/stable/standalone.4.0.html?pr_merchant_id=867678&pr_locale=en_CA&pr_page_id=056594017993&pr_api_key=f40b12ae-7efa-423a-8f12-cb902debf1c0&pr_merchant_group_id=80915&pr_merchant_id=867678&pr_merchant_group_id=8091 (the “SDM NIVEA Anti-Wrinkle Specialist Page”). Once you have left a review on both platforms, send a screenshot of both reviews to the Giveaway Organizer via direct message (“DM”) on Instagram at @nivea_canada. You will then obtain one (1) entry in the Contest.

4. PRIZES

There are ten (10) Prize Packs (each a “Prize”) in total to be won, a Prize per Winner. A Prize consist of the following:

• Two (2) NIVEA Packs: The Firming Duo (one NIVEA Q10 Power Anti-wrinkle Firming Day Cream + NIVEA Q10 Power Anti-wrinkle Replenishing Night Cream) approximately valued at $64.

  Total value a Prize: approximatively $640 (taxes are excluded).

Conditions. Prize must be accepted as awarded and may not be substituted, transferred or redeemed for cash or otherwise; however, Giveaway Organizer reserves the right to substitute a prize of equal or greater value at its sole discretion, if a prize cannot be awarded as described herein for any reason. 

5. SELECTION PROCESS

LIMIT OF ONE (1) ENTRY PER PERSON. THE EMAIL ADDRESS AND NAMES WILL BE TAKEN INTO ACCOUNT TO VOID MULTIPLE ENTRIES. 

Duplication, or any attempts to exceed the maximum number of entries per person is a violation of these Official Giveaway Rules and may result in disqualification.  Use of automated devices is prohibited; automated entries (including but not limited to entries submitted using any robotic, script, macro, or other automated service) are not permitted and may result in disqualification.

6. AWARDING OF THE PRIZES

A representative from Giveaway Organizer, will notify each selected entrant by DM within ten (10) days of the Draw Date. If a selected entrant (a) cannot be reached by DM within five (5) business days of notification; (b) fails to correctly answer the skill testing question; or otherwise does not meet all of the Contest conditions as per the Contest Rules, the selected entrant will be disqualified and shall forfeit any rights to the Prize without any liability to the Giveaway Organizer , and a second random draw will occur and the above process will be repeated until such time as there is one (1) confirmed Prize winner, or no more eligible entries, whichever comes first. The Giveaway Organizer will not be responsible for failed attempts to contact a selected entrant.

Winning a Prize is contingent on fulfilling all the requirements set forth herein. To be declared a winner, any selected entrant must have declared that he/she has fully complied with these Giveaway Rules, including the eligibility requirements. 

Failure to comply with one of the conditions mentioned in these Giveaway Rules or to accept the prize will cause the selected entrant to be disqualified. In such a case, the Sponsor may, at its sole discretion, cancel the prize or select another eligible entry received during the Giveaway Period. 

Prize will be shipped to the winners at the address provided on the Entry Form within four (4) to six (6) weeks of the prize notification e-mail. All prizes that are not awarded or returned as undeliverable will automatically be cancelled. Sponsor is not responsible for invalid contact information provided by a selected entrant.

7. PERSONAL INFORMATION

***The Personal information that you provide when you register and enter this Giveaway is being provided to the Giveaway Organizer. The Giveaway Organizer and its authorized agents will only use and disclose the personal information you provide when you register and enter the Giveaway for the purposes of administering the Giveaway and prize fulfillment, unless you otherwise agree. By accepting a prize, the winner agrees to the Giveaway Organizer's use of his/her name, city/province of residence, biographical information, statements, voice and likeness in any advertising and publicity the Giveaway Organizer may conduct relating to the Giveaway in any media or format, whether now known or hereafter developed, including but not limited to the World Wide Web, at any time or times in perpetuity, without further compensation or notice. Aggregate and/or anonymized Giveaway winner information may be used by the Giveaway Organizer to communicate about the Giveaway to its retailers and distributors. 8.  INSTRAGRAM, FACEBOOK AND TIKTOK

This Contest is in no way sponsored, endorsed, or administered by or associated with Instagram/Facebook/TikTok. You understand that you are providing your information to the Giveaway Organizer and not to Instagram/Facebook/TikTok. The information you provide will only be used as noted in the disclosure statement.

9. GENERAL CONDITIONS

By entering this Giveaway, entrants agree to abide by these Giveaway Rules. All entries are subject to verification by the Giveaway Organizer. Any entry which is, as the case may be, incomplete, fraudulent, submitted late, showing a wrong email address or phone number or otherwise noncompliant shall be rejected and will not entitle the entrant to be entered in the giveaway. 

The Giveaway Organizer reserves the right to disqualify an entrant or to cancel one or several entries by an entrant who participates or tries to participate in this giveaway by using methods that do not comply with these giveaway rules or that are unfair to the other entrants (e.g. entries exceeding the authorized limit). Such an entrant shall be reported to the appropriate legal authorities. 

The prize must be accepted as described in these giveaway rules and may not be transferred to another person, replaced by another prize or exchanged in whole or in part for cash, except as provided in the section below. 

The Giveaway Organizer reserves the right to replace a prize (or a portion thereof) with one of the same kind and of equivalent value or, at its sole discretion, with the cash value of the prize (or a portion thereof) as indicated in the giveaway rules.

Each winner releases and holds harmless the Giveaway Organizer, their affiliates, their advertising and promotional agencies, and their employees, agents and representatives from and against any damage resulting from the acceptance or use of the prize. 

The person selected for a prize acknowledges that from the moment they receive the winning confirmation letter from the Giveaway Organizer, the fulfillment of prize-related obligations becomes the full and sole responsibility of the various service suppliers and manufacturers, as the case may be.  

The Giveaway Organizer, their affiliates, their advertising and promotional agencies, and their employees, agents and representatives, disclaim all liability for any of the following that may limit or prevent any entrant’s participation in the giveaway: malfunctioning of any computer component, software or communications line; loss or lack of a communications network; or any transmission that is faulty, incomplete, incomprehensible or erased by any computer or network. The Giveaway Organizer, their affiliates, their advertising and promotional agencies, and their employees, agents and representatives also disclaim all liability for any damages or loss that may be caused, directly or indirectly, in whole or in part, by the downloading of any Web page or software or by the transmission of any information related to participation in the giveaway.

The Giveaway Organizer does not warrant that access to or use of the giveaway website will be uninterrupted during the Giveaway Period or error-free.

The Giveaway Organizer reserves the right, at its sole discretion, to cancel, modify or suspend this giveaway in whole or in part, or to terminate it, should human intervention or an event take place that could modify or affect the administration, security, impartiality or conducting of the giveaway as provided in these giveaway rules, subject to approval by the Régie des alcools, des courses et de jeux du Québec if necessary.

In the event that the computer system cannot record all the giveaway entries during the Giveaway Period for whatever reason, or if participation in the giveaway must be terminated in whole or in part before the end date of the giveaway as provided in the giveaway rules, the Giveaway Organizer, at its discretion and without liability to any entrant or intended entrant, may proceed with the selection among the entries duly registered during the Giveaway Period or, as the case may be, up to the date of the event terminating participation in the giveaway. 

In no event shall the Giveaway Organizer, its affiliates, their advertising and promotional agencies, the suppliers of goods, materials or services related to this giveaway, and their employees, agents and representatives be required to award more prizes than those indicated in these giveaway rules or to award a prize otherwise than in accordance with these giveaway rules.

Persons who enter or try to enter this giveaway release the Giveaways Organizer, his/her affiliates, their advertising and promotional agencies, and their employees, agents and representatives from any liability for damage they may incur as a result of their participation or their attempt to participate in the giveaway.

Each selected entrant authorizes the Giveaway Organizer and its representatives to use its name, photo, likeness, statement regarding the prize, place of residence and/or voice for publicity purposes, without any additional form of compensation.

Any decision by the Giveaway Organizer or its representatives regarding this giveaway is final and without appeal, subject to a ruling by the Régie des alcools, des courses et des jeux du Québec on any issue under its jurisdiction or any other authority having jurisdiction in any other province of Canada.

For the purposes of these giveaway rules, the entrant is the person whose personal information appears on the entry form.  It is to this person to whom the prize will be awarded if he/she is selected and declared a winner.

For Quebec residents, any litigation respecting the conduct or organization of a publicity giveaway may be submitted to the Régie des alcools, des courses et des jeux du Québec for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie for the purpose of helping the parties reach a settlement.

No communication or correspondence related to this giveaway shall be exchanged with entrants except as provided for in the present giveaway rules or at the Giveaway Organizer’s initiative. 

If a section of the giveaway rules is declared or deemed illegal, unenforceable or invalid by a competent court, that section shall be considered invalid, but all unaffected sections will be applied within the limits of the law. 

Any attempt to deliberately damage the website of this giveaway and/or any related site or to sabotage the legitimate course of this giveaway constitutes a violation of civil and criminal laws.  Should there be any threats of violations, the Giveaway Organizer reserves the right to reject the entrant’s entries and obtain legal or equitable relief under the applicable laws. 

In case of any discrepancy between the French and English versions of these giveaway rules, the English version shall prevail.
