WIN A TRIP TO RECONNECT WITH SOMEONE YOU LOVE AND EXPERIENCE #NIVEAMoments! (the “Contest”) is sponsored by Beiersdorf Canada Inc. (the “Contest Sponsor”)
1. NO PURCHASE NECESSARY. The Contest starts on October 14th, 2021 and closes on November 11, 2021 at 5:00 PM (ET) (the “Contest Period”). The Winner will be announced via the NIVEA Canada Instagram Page at www.instagram.com/niveacanada/ on November 15, 2021.
2. ELIGIBILITY: The Contest is open to legal residents of Canada who, at the time of entry, have reached the age of majority in their province/territory of residence. Employees of Contest Sponsor, its agents, representatives, affiliates, subsidiaries, franchisees, advertising and promotional agencies, fulfillment houses and members of their respective immediate families or those with whom they are domiciled, are not eligible to enter the Contest. In the Contest Rules, “immediate family” means mother, father, brothers, sisters, sons, daughters, legal or common-law spouse, regardless of where they reside. Groups, clubs, organizations, businesses, and commercial and non-commercial entities cannot participate. All decisions of Contest Sponsor are final.
3. HOW TO ENTER: NO PURCHASE NECESSARY. Internet access and valid Instagram or TikTok account are required. During the Contest Period, upload a video or photograph of yourself reconnecting with a loved one to the Instagram platform or to the TikTok platform, and use the hashtag #NIVEAmoments. You will then obtain one (1) entry in the Contest.
4. LIMIT: One (1) entry per person for the Contest Period. The use of multiple Instagram accounts is prohibited.
5. CHANCES OF WINNING: The odds of winning the Grand Prize depend on the total number of eligible entries received during the Contest Period.
6. DRAW: One (1) entry will be randomly selected from among all eligible entries received during the Contest Period. The draw will occur November 12, 2021 (“Draw Date”). All entries become the property of Contest Sponsor and none will be returned. No responsibility is assumed by the Contest Group (as defined below) for any inability of a potential entrant to successfully enter the Contest for any other reason. A representative from Contest Sponsor, the Contest administrator, will notify the selected entrant by direct message (“DM”) within ten (10) days of the Draw Date. If the selected entrant (a) cannot be reached by DM within five (5) business days of notification; (b) fails to correctly answer the skill testing question (see rule 6); (c) fails to return the properly executed Release Form (defined in rule 6) within the specified time (see rule 6); or otherwise does not meet all of the Contest conditions as per the Contest Rules, the selected entrant will be disqualified and shall forfeit any rights to the Grand Prize without any liability to the Contest Group (defined in rule 6), and a second random draw will occur and the above process will be repeated until such time as there is one (1) confirmed prize winner, or no more eligible entries, whichever comes first. The Contest Sponsor will not be responsible for failed attempts to contact a selected entrant.
7. WINNER’S OBLIGATION: To be confirmed a winner, the selected entrant must: (1) correctly answer, without assistance of any kind, whether mechanical or otherwise, a mathematical skill testing question to be administered by phone or email or within the Release Form (defined in 6(2)) and (2) sign and return within five (5) business days of its receipt a standard declaration/liability release and consent to publicity form (“Release Form”) confirming compliance with the Contest Rules, and releasing the Contest Sponsor, and each of their agents, representatives, affiliates, subsidiaries, franchisees, advertising and promotional agencies, fulfillment houses, and all of their respective shareholders, employees, parents, directors, officers, franchisees, successors, and assigns (collectively, the “Contest Group”) from all liability with respect to the entrant’s participation in this Contest and the awarding, use and/or misuse of the Grand Prize or for matters that inhibit, reduce or prevent enjoyment of the Grand Prize. The selected entrant may be required to show proof of identification as part of the confirmation process. In case of a dispute concerning the identity of the individual who submitted an entry, the entrant will be deemed to be the account holder of the Instagram account under which the entry was submitted. If for any reason the selected entrant’s name does not match the account holder’s name, the selected entrant will be disqualified and will forfeit all rights to the Grand Prize without liability to the Contest Sponsor.
8. GRAND PRIZE: There will be one (1) grand prize (the “Grand Prize”) available to be won, consisting of one travel voucher/gift card for one (1) person toward the purchase of air travel, subject to the terms and conditions of the travel voucher/gift card and, subject to the federal, provincial and Public Health Canada regulations. Prize is valued at approximately $2,000 (CAD) and cannot be exchanged for value. The prize excludes transportations, meals, and other miscellaneous expenses.
9. DISQUALIFICATION: Use of automated devices is prohibited; automated entries (including but not limited to entries submitted using any robotic, script, macro, or other automated service) are not permitted and may result in disqualification. Entry are subject to verification by the Contest Sponsor.
10. PUBLICITY RELEASE: Each entrant authorized the Sponsor and its representatives to use his/her name, photo, likeness, statement regarding the prize, place of residence and/or voice, for publicity purposes, without any additional form of compensation.
11. INSTAGRAM,FACEBOOK AND TIKTOK: This Contest is in no way sponsored, endorsed, or administered by or associated with Instagram/Facebook/TikTok. You understand that you are providing your information to the Contest Sponsor and not to Instagram/Facebook/TikTok. The information you provide will only be used as noted in the disclosure statement.
12. PERSONAL INFORMATION: Contest Sponsor and its authorized agents will only use and disclose the personal information you provide when you register and enter the Contest for the purposes of administering the Contest. Contest Sponsor and its authorized agents may request additional personal information for administering prize fulfillment unless you otherwise agree. No further informational or marketing communications will be received by the entrant unless the entrant provides the Contest Sponsor with explicit permission to do so. 13. GENERAL RULES: Winning a prize is contingent on fulfilling all the requirements set forth herein. All entries become the property of Contest Sponsor and will not be returned or acknowledged. Mass entries, automated entries, entries submitted by third parties, and any entries or prize claims that are late, incomplete, fraudulent, illegible, unidentified, or delayed will be void. All entries and prize claims are subject to verification. Proof of entry submission does not constitute proof of receipt. By entering this Contest, entrants agree to abide by these Contest Rules. Decisions of Contest Sponsor and/or the Contest Judging Organization will be final and binding on all matters pertaining to this Contest. Contest is subject to all applicable federal, provincial, and municipal laws. Contest Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process, the operation of the Contest, violates the Contest Rules, or acts with intent to annoy, abuse, threaten or harass any other person.
14. LIMITATIONS OF LIABILITY AND RELEASES: The Contest Group shall not be liable to the confirmed Grand Prize winner or the Grand Prize for any guarantee, warranty, condition or representation, express or implied, relating to the prize, including without limitation, its quality, condition or fitness for a particular purpose. The Contest Group does not assume any responsibility or liability for, and each entrant and winner assumes liability for, and releases and holds harmless the Contest Group from and against any and all losses, damages, costs, actions, liabilities, claims, demands, or injuries caused or claimed to be caused by participation or attempted participation in the Contest, the administration of the Contest, the selection and confirmation of winner, the awarding of the prize, and/or the acceptance, possession, any travel related thereto, use or misuse of the prize awarded, including but not limited to claims/damages for personal injury, property damage or death (to the extent permitted by law). Without limiting the foregoing, the Contest Group and the Contest Sponsor shall not be responsible for: (a) any incomplete or inaccurate information that is caused by Instagram users, or by any of the equipment or programming associated with or utilized in the Contest, or by any technical or human error which may occur in the processing of submissions in the Contest; (b) lost, interrupted, or unavailable network, server, service provider, on-line systems, telephone networks or telephone lines, or any other connections; (c) the theft, destruction, loss or unauthorized access to, or alteration of, entries; (d) any problems with, or malfunctions or failures of, telephone networks or lines, computers or computer on-line systems, servers or providers, computer equipment, software, viruses or bugs; (e) garbled transmissions or miscommunications; (f) failure of post to be received by or from the Contest Sponsor for any reason, including but not limited to traffic congestion on the Internet or at any website or combination thereof or technical incompatibility; (g) damage to a user's computer equipment (software or hardware) occasioned by participation or downloading of materials related to this Contest; (h) printing, distribution, programming or production errors, and any other errors or malfunctions of any kind, whether human, mechanical, electronic or otherwise. The Contest Group and its agents are not responsible for typographical or other errors in the Contest or administration of this Contest, including, but not limited to, errors in advertising, the Contest Rules, the selection and announcement of winner, distribution of prize or technical malfunctions of telephone network lines, computer online systems or providers, software and hardware configurations, or failure of any entry to be received by Contest Sponsor for any reason.
15. RIGHT TO VOID/TERMINATE/SUSPEND/MODIFY: Any materials used in this Contest which have been tampered with, mutilated, altered, forged, reproduced, not legitimately obtained, are illegible or which contain or reflect computer, software, printing, production or other errors will be void. Contest Sponsor reserves the right, subject to the approval of the Régie des alcools, des courses et des jeux (the “Régie”) with respect to residents of Quebec, to terminate, suspend or modify this Contest, in whole or in part, at any time and without notice or obligation if, in Contest Sponsor's sole opinion, any factor interferes with its proper conduct as contemplated by these Contest Rules. Without limiting the generality of the foregoing, if the Contest, or any part thereof, is not capable of running as planned for any reason, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, printing errors, programming errors, seeding errors, technical failures, or any causes beyond the reasonable control of Contest Sponsor, which, in the sole opinion of Contest Sponsor, corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Contest Sponsor may, in its sole discretion and subject only to the approval of the Régie in Quebec, void any suspect entries and: (a) terminate the Contest, or any portion thereof; (b) modify or suspend the Contest, or any portion thereof, to address the impairment and then resume the Contest, or relevant portion, in a manner that best conforms to the spirit of these Contest Rules; and/or (c) award the prize from among the eligible, non-suspect entries received up to the time of the impairment in accordance with the winner selection criteria discussed above. No more than the above-stated number of prizes will be awarded. Should any error of any kind, whether technological, printing, production, human or otherwise, or any other event result in more prizes being claimed than the number stated above, the prizes not yet awarded may be awarded in a random drawing from amongst all eligible claimants who have not yet received a prize. In any such drawing, the selected entrants must correctly answer, without assistance of any kind, whether mechanical, electronic or otherwise, a mathematical time-limited skill-testing question to be administered by DM, telephone, or email and exclude any documents as may be required before being declared a winner.
16. FOR QUEBEC RESIDENTS: Any litigation regarding the conduct or organization of this Contest may be submitted to the Régie for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
17. PERMITTED LAW: In the event of any discrepancy or inconsistency between the terms and conditions of these English Contest Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to: French version of these Contest Rules, and/or point of sale, television, print or online advertising, the terms and conditions of these English Contest Rules shall prevail, govern and control. All issues and questions concerning the construction, validity, interpretation, and enforceability of the Contest Rules, or the rights and obligations of entrants and Contest Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with (i) the laws of the Province of Québec and the laws of Canada applicable therein in respect of residents of the Province of Québec, and (ii) the laws of the Province of Ontario and the laws of Canada applicable therein in respect of residents of the other Canadian provinces/territories, without regard to conflicts of law principles. Any attempt by an entrant or any other individual to deliberately damage any website or undermine the legitimate operation of the Promotion could be a violation of criminal and civil laws and should such an attempt be made; the Contest Sponsor reserve the right to seek damages from any such person to the fullest extent permitted by law. This promotion is subject to all federal, provincial/territorial, and municipal laws.
